TERMS AND CONDITIONS OF AGENCY
We agree to accept your instructions to offer your property as described for sale on the open market at the agreed asking price and any variation in this price will not affect this agreement.
SOLE SELLING RIGHTS
You will be liable to pay remuneration to The Boom
Group in addition to any other costs or charges agreed, in each of the
following circumstances: -
If unconditional
contracts for the sale of the property are exchanged in the period during which
we have Sole Selling Rights, even if the
purchaser was not found by us, but, by another agent or by any other person,
including yourself.
If unconditional
contracts for the sale of the property are exchanged after the expiry of the
period during which we have Sole Selling Rights, but, to a purchaser who was
introduced to you during that period or with whom we had negotiations about the
property during that period.
THE AGENCY PERIOD
The agency period will be indefinite unless either party terminates the agreement by giving 14 days written notice.
PAYMENTS OF FEES
Our account for our fees will be sent direct to your solicitor on exchange of contracts for payments on completion of the sale. A copy will be sent to your information and for you to check. V.A.T will be charged at the current rate.
ESTATE AGENCY SERVICES
We reserve the right to offer our services by way of Estate Agency to anyone interested in purchasing your property including financial services, mortgage facilities, life assurance and property insurance and confirm that we will offer out a free valuation for anyone wishing us to do so and that should they wish to give us instructions to sell their property, we will feel free to accept these instructions.
ESTATE AGENTS BOARD
Upon receiving the
vendors authority, The Boom Group will erect a ‘for sale’ board on the
property. Upon giving such authority, the vendor agrees not to instruct any
other agent to place a board on the property, without prior notification to The
Boom Group.
The Boom Group will
indemnify the vendor against any action which may be taken against him/her
under the Town and Country Planning (Control of Advertisements) Regulations
1989, in respect of any board supplied and erected by The Boom Group, unless
such action arises from placing of a second board by any other person.
ESTATE AGENTS ACT 1979
This act requires The
Boom Group to disclose any interest
which vendors or their relatives may have in The Boom Group. Please give
details of any such relationship to enable us to comply with this requirement.
In accordance with Estate
Agents ( Provision of Information ) Regulations 1991 we are obliged to inform
you that we intend offering to prospective purchasers, insurance, financial
assistance, estate agency services and any other special offers which may be
available from time to time.
In accordance with the
Property Misdescriptions Act 1991-
‘I hereby confirm that I have read the descriptive information you have prepared relating to my property, and that to the best of my knowledge and belief these particulars do not contain any error, or material misrepresentation. I also confirm that I will notify you immediately if, prior to exchange of contracts, any defaults or problems develop or there is any material change involving any of the fixtures and fittings or the property itself’.
Discrimination
It is our policy that
in providing our service, no applicant or client will receive less favourable
treatment on the grounds of race, colour, ethnic origin, religion, sex, marital
status or physical handicap.
UNOCCUPIED PROPERTIES
We are not responsible
for the maintenance or repair of your property if it is unoccupied unless we
have agreed otherwise in writing. It is your responsibility to ensure that
mains services are turned off, water and heating systems professionally drained
and the insurers notified.
